Section 1 Definitions
Consumer means a Service Recipient who is a natural person entering into the Agreement or taking steps to conclude it, outside the scope of any business or professional activity.
Newsletter means messages regarding the Store, including offers, promotions and new product updates, provided free of charge by the Service Provider to the Service Recipient under the Agreement, constituting digital content within the meaning of the Consumer Rights Act.
Privileged Entrepreneur means a natural person Service Recipient entering into or intending to enter into the Agreement in connection with their business activity, where such agreement is not of a professional nature.
Terms and Conditions means these binding Newsletter regulations.
Store means the Apawwa online store operated by the Service Provider at www.apawwa.eu.
Agreement means the contract for the provision of Newsletter services.
Service Recipient means any entity that has concluded or intends to conclude the Newsletter service agreement.
Privileged Service Recipient means a Service Recipient who is either a Consumer or a Privileged Entrepreneur.
Service Provider means ZHENGDA INTERNATIONAL IMPORT-EXPORT LIMITED LIABILITY COMPANY, with registered office at ul. Nadrzeczna 16/H1/D34, 05-552 Wólka Kosowska, entered into the National Court Register kept by the District Court for Warsaw-Mokotów, 14th Commercial Division of the National Court Register, KRS number 0000392579, NIP 5272661356, REGON 14332829600000.
Consumer Rights Act means the Polish Act on Consumer Rights of 30 May 2014.
Section 2 Contact with the Service Provider

- Costs of telephone calls or data transmission incurred by the Service Recipient shall be calculated according to the standard tariffs of their telecommunications operator or internet service provider. The Service Provider advises that international call and data transmission costs may be higher than domestic rates, depending on the pricing policy of the relevant service provider.
Section 3 Technical Requirements
- To access the digital content covered by these Terms and Conditions, the following is required:
An active email address;
An internet-connected device;
A web browser supporting JavaScript and cookies.
Section 4 Agreement
- Subscription to the Newsletter is entirely voluntary.
- Conclusion of the Agreement is mandatory to receive Newsletter content.
- All email communications sent under the Agreement shall be delivered to the email address provided by the Service Recipient at the time of subscription.
- To complete subscription, the Service Recipient shall enter their email address in the designated field on the Store website. Completion of the subscription process forms an open-ended agreement, and the Service Provider shall commence Newsletter delivery in accordance with these regulations.
- The Service Recipient is required to provide a valid and correct email address for proper service performance.
- Newsletter content shall be delivered promptly after being created and issued by the Service Provider.
- Every Newsletter email shall include clear information and an unsubscribe link.
- The Service Recipient may unsubscribe from the Newsletter at any time, free of charge and without giving any reason, either via the dedicated unsubscribe link in each message or by sending a cancellation request to the Service Provider’s email address.
- Using the unsubscribe link or submitting a formal cancellation request shall result in immediate termination of the Newsletter service agreement.
Section 5 Complaints
General Provisions
- All complaints relating to Newsletter digital content shall be submitted to the postal or email contact address specified in Section 2.
- The Service Provider shall respond to all formal complaints within 14 days from the date of receipt.
Rights of Privileged Service Recipients
- The Service Provider shall be liable for full compliance with the Agreement in accordance with generally applicable legal regulations, in particular the Consumer Rights Act.
- In the event of improper or inadequate provision of Newsletter services, privileged Service Recipients may exercise statutory remedies specified in the relevant provisions of the Consumer Rights Act.
- If agreed digital Newsletter content is not delivered, the privileged Service Recipient may request immediate performance. Should the Service Provider fail to deliver the content promptly or within an additional mutually agreed timeframe, the Service Recipient may terminate the Agreement.
- Immediate termination without prior service request is permitted if the Service Provider clearly declares that it will not deliver the agreed digital content, or if a fixed delivery deadline was contractually essential and subsequently missed by the Service Provider.
- The Service Provider shall remain liable for any non-compliance of ongoing Newsletter services that occurs or is identified during the term of the Agreement.
- Where Newsletter content fails to meet contractual requirements, privileged Service Recipients may demand corrective measures to restore full service compliance.
- In the event of service non-compliance, the privileged Service Recipient shall reasonably cooperate with the Service Provider, using the least restrictive technical means available, to verify whether delivery issues result from local digital environment conditions.
- Privileged Service Recipients may terminate the Agreement if corrective action is impossible or involves excessive costs, if the Service Provider fails to resolve non-compliance within a reasonable timeframe and without undue inconvenience, if service defects persist after attempted corrections, if non-compliance is substantial, or if the Service Provider confirms it cannot resolve service issues in a reasonable period.
Out-of-Court Dispute Resolution
- Consumers may use official out-of-court complaint and dispute resolution mechanisms. Available options include free assistance from European Consumer Centres for cross-border matters, the European Commission’s Online Dispute Resolution (ODR) platform, mediation services organised by local Trade Inspection authorities and permanent consumer arbitration courts operating in Poland. All official reference links and support information are provided for informational purposes.
- These provisions are for guidance only and do not oblige the Service Provider to participate in alternative dispute resolution procedures.
- Out-of-court dispute resolution is fully voluntary for both the Service Provider and the Consumer.
- Consumers may obtain free additional support from local municipal or county consumer protection officers.
Section 6 Right of Withdrawal from the Agreement
- Privileged Service Recipients may withdraw from the Newsletter service agreement within 14 days without stating any reason.
- The 14-day withdrawal period commences on the date the Agreement is concluded.
- To exercise the right of withdrawal, the Service Recipient shall notify the Service Provider by clear written statement sent via post or email using the contact details listed in Section 2.
- The Service Recipient may use the model withdrawal form attached to these Terms and Conditions, though its use is not mandatory.
- Sending a valid withdrawal notification before the expiry of the 14-day period is sufficient to meet statutory deadlines.
Section 7 Personal Data
- The Service Provider acts as Data Controller for all personal data provided in connection with the Newsletter Agreement. Full details regarding data processing purposes, legal bases, recipient categories and user rights are published in the Store’s Privacy Policy, drafted in compliance with the EU General Data Protection Regulation (GDPR) and transparency requirements.
- Personal data shall be processed for the following purposes:
Performance of the Newsletter Agreement, based on contractual necessity;
Analysis of newsletter campaign effectiveness for internal business optimisation, based on the Service Provider’s legitimate interest;
Establishment, defence and settlement of potential legal claims, based on legitimate business interest. - Provision of personal data is voluntary yet contractually necessary. Refusal to provide required data will prevent the conclusion of the Agreement and the delivery of Newsletter services.
- User data shall be stored until the Agreement expires, until all related legal claims are resolved, or until a valid objection to data processing is submitted, whichever condition applies first.
- Service Recipients have the right to access, rectify, erase, restrict processing, receive data in a transferable format and object to processing based on legitimate business interests at any time.
- To exercise data protection rights, the Service Recipient shall contact the Service Provider directly.
- If the Service Recipient believes their data is processed unlawfully, they may submit a complaint to the Polish Office for Personal Data Protection.
Section 8 Amendments to Terms and Conditions or Newsletter Service
- The Service Provider reserves the right to amend these Terms and Conditions for valid reasons, including Newsletter functionality updates, changes in legal regulations, compliance with official authority requirements and updates to company contact details.
- Notice of planned amendments shall be sent to the registered newsletter email address at least 7 days before changes take effect.
- Failure to submit a written objection before the effective date shall be deemed acceptance of the updated regulations, without affecting future termination rights.
- Service Recipients who reject proposed amendments shall notify the Service Provider by email, resulting in automatic Agreement termination upon the changes taking effect.
- Non-essential Newsletter service adjustments may be implemented by the Service Provider without additional charges for privileged users, with the same notification rules applied accordingly.
- Any material changes that negatively impact Newsletter access or usability shall be communicated in durable written form with reasonable advance notice, including full details of modifications, effective dates and user statutory rights.
Section 9 Final Provisions
- The Service Recipient is prohibited from transmitting illegal, harmful or unauthorised content through the Newsletter service system.
- The Agreement is originally concluded in the Polish language.
- All Newsletter agreements are governed by the laws of Poland.
- Mandatory consumer protection provisions shall take precedence over Polish law whenever wider statutory protection applies to individual Consumers.
- All disputes involving non-privileged business users shall fall under the exclusive jurisdiction of the court competent for the Service Provider’s registered address.
