Apawwa Online Store Regulations
This document specifies, among other things, the rules for concluding contracts via the Store, and contains key information about the Seller, the Store and consumer rights.

Section 1 Definitions
Business Days – Monday to Friday, excluding statutory public holidays in Poland.Civil Code – the Polish Civil Code Act of 23 April 1964.Consumer – a natural person purchasing goods in the Store or taking actions aimed at completing a purchase, not related to their business or professional activity.
Account – a digital service regulated by separate terms, within the meaning of the Consumer Rights Act, allowing the Buyer to use additional free functions in the Store.
Buyer – any entity making a purchase or taking steps to complete a purchase in the Store.
Privileged Buyer – a Consumer or Privileged Entrepreneur.
Privileged Entrepreneur – a natural person entering into or intending to enter into a contract with the Seller under these Regulations in connection with their business activity, yet not for professional purposes.
Regulations – these store terms and conditions.
Store – the Apawwa online store operated by the Seller at www.apawwa.eu.
Seller – ZHENGDA INTERNATIONAL IMPORT-EXPORT LIMITED LIABILITY COMPANY, seated at ul. Nadrzeczna 16/H1/D34, 05-552 Wólka Kosowska, entered into the National Court Register maintained by the District Court for Warsaw-Mokotów, 14th Commercial Division of the National Court Register, under KRS number 0000392579, NIP 5272661356, REGON 14332829600000.
Consumer Rights Act – the Polish Consumer Rights Act of 30 May 2014.

- Costs of telephone calls or data transmission incurred by the Buyer shall be determined by the tariffs of the telecommunications operator or internet service provider used by the Buyer. The Seller informs that international call or data transmission costs may be higher than domestic rates, depending on the applicable operator tariffs.
Section 3 Technical Requirements
- Proper operation of the Store requires:
- A device with internet access
- A web browser supporting JavaScript and cookies.
- Placing an order in the Store additionally requires an active email address.
Section 4 Shopping at the Store
- All product prices displayed in the Store are final gross prices.
- The total order price includes the product price and applicable delivery costs, as indicated in the Store.
- Selected products must be added to the shopping cart.
- The Buyer shall select a delivery method and available payment option, and provide all data necessary to process the order.
- An order is deemed placed once the Buyer confirms its content and accepts these Regulations.
- Order placement constitutes the conclusion of a sales contract between the Buyer and the Seller.
- The Buyer may register for a Store Account or make purchases without registration by entering required data for each order.
Section 5 Payments
- The Store supports the following payment method:
- Online payments processed via the Autopay payment platform.
- Autopay S.A. is the service provider for online payment transactions.
- For prepaid orders, full payment must be completed within 3 Business Days of order placement.
- By shopping at the Store, the Buyer consents to the issuance of electronic invoices by the Seller. The Buyer retains the right to withdraw this consent at any time.
Section 6 Order Fulfillment
- Order processing times are stated directly in the Store.
- Prepaid orders will only be processed after full payment has been received.
- For single orders containing products with different processing times, the longest lead time shall apply to the entire order.
- Delivery services are available exclusively within the territory of the Republic of Poland.
- Available delivery methods:
- Courier delivery
- InPost parcel locker collection.
Section 7 Right of Withdrawal from the Contract
- Subject to Section 8 of these Regulations, a Privileged Buyer may withdraw from a distance contract concluded via the Store within 14 calendar days without providing any reason.
- The 14-day withdrawal period shall commence on the following dates:
- Where the Buyer or a third party authorised by the Buyer takes physical possession of the goods;
- For multiple goods delivered separately, in batches or in parts, the day on which the Buyer or authorised third party receives the final item, batch or consignment.
- To exercise the right of withdrawal, the Buyer shall notify the Seller of their decision via a clear written statement, using the contact details specified in Section 2. Notices may be sent by post or email.
- The Buyer may use the model withdrawal form attached to these Regulations, though its use is not mandatory.
- The withdrawal deadline shall be met if the Buyer submits the withdrawal notification before the expiry of the 14-day period.
Consequences of Withdrawal
- Following valid contract withdrawal, the Seller shall refund all payments received from the Privileged Buyer, including standard delivery costs, excluding additional fees for non-standard delivery methods more expensive than the cheapest standard option offered. Refunds will be processed promptly, no later than 14 days from receipt of the withdrawal notification.
- Refunds will be issued using the original payment method, unless the Buyer explicitly agrees to an alternative solution. No additional charges will be applied for refunds.
- The Seller may withhold reimbursement until receiving returned goods or valid proof of return shipment, whichever occurs first, unless the Seller arranges personal goods collection.
- Goods must be returned to the designated address promptly and no later than 14 days from submitting the withdrawal notice. The return deadline is satisfied if goods are dispatched within the 14-day timeframe.
- The Privileged Buyer shall bear the direct costs of returning goods.
- The Buyer is liable only for any reduction in product value resulting from handling beyond what is necessary to inspect the goods’ condition, features and functionality.
- For goods which cannot be returned via standard postal services due to their nature, the Buyer shall cover special return costs. Estimated return fees will be listed on product pages or during checkout.
Section 8 Exceptions to the Right of Withdrawal
The statutory 14-day withdrawal right for distance contracts shall not apply to:
- Custom-made goods manufactured to the Buyer’s individual specifications or tailored to personal requirements;
- Perishable goods or products with a short shelf life;
- Sealed goods which cannot be returned for health or hygiene reasons once the original packaging has been opened after delivery;
- Goods permanently combined with other items after delivery;
- Sealed audio, video or software products where the original seal has been broken;
- Newspaper, magazine and periodical subscriptions;
- Goods or services whose price is subject to unpredictable financial market fluctuations outside the Seller’s control.
Section 9 Complaints
General Provisions
- The Seller shall be liable for contractual compliance in accordance with applicable Polish law, including the Consumer Rights Act.
- All complaints, including those relating to Store functionality, must be submitted to the postal or email address listed in Section 2.
- Product warranty information and terms are available on relevant product pages within the Store.
- The Seller shall respond to all formal complaints within 14 days of receipt.
Rights of Privileged Buyers
- In the event of product non-compliance with the contract, Privileged Buyers may exercise remedies set out in the Consumer Rights Act.
- The Seller shall be liable for inherent product defects existing at the time of delivery and identified within two years of purchase, unless a longer manufacturer warranty period applies.
- In cases of non-compliance, the Buyer may request:
- Product replacement
- Product repair.
- The Buyer may additionally submit a request for price reduction or contract termination if:
- The Seller refuses to repair or replace non-compliant goods;
- Remedial action fails to resolve non-compliance issues;
- Defects persist despite attempted correction by the Seller;
- Significant non-compliance justifies immediate price reduction or contract termination;
- The Seller confirms remedial action will cause excessive inconvenience or unreasonable delays.
- Goods requiring repair or replacement must be made available to the Seller, with collection costs covered by the Seller.
- Contract withdrawal is not permitted for minor, insignificant product defects.
- In cases of justified contract termination due to non-compliance, goods shall be returned at the Seller’s cost to the specified address. Full refunds will be issued within 14 days of receiving returned goods or delivery confirmation.
- Price reduction reimbursements will be processed within 14 days of receiving a formal price reduction request.
Out-of-Court Dispute Resolution
- The Seller informs Consumers of available out-of-court complaint and dispute resolution procedures. Relevant procedures are available via authorised national and European consumer bodies. Consumers may use:
- Free support from European Consumer Centres for cross-border shopping disputes;
- The European Commission’s Online Dispute Resolution (ODR) platform;
- Mediation services provided by local Trade Inspection authorities in Poland;
- Permanent consumer arbitration courts operating under regional Trade Inspection offices.
- These provisions are informational only and do not oblige the Seller to participate in out-of-court dispute proceedings.
- Out-of-court dispute resolution is entirely voluntary for both parties.
- Consumers may seek free assistance from local municipal or county consumer ombudsmen.
Rights of Non-Privileged Buyers
- Business buyers and non-privileged entrepreneurs may submit defect claims under the warranty provisions of the Polish Civil Code.
- The Seller shall remain liable for physical product defects identified within two years of goods dispatch.
- Business buyers forfeit warranty rights if they fail to inspect goods promptly and notify the Seller of detected defects without delay.
- Under Civil Code regulations, non-privileged buyers may request price reductions, contract termination for major defects, defect removal or replacement with defect-free goods.
- Defective goods submitted for inspection or repair must be sent to the Seller’s designated address at the buyer’s cost.
Section 10 Personal Data
- The Seller acts as the data controller for all personal data provided by Buyers when using the Store. Full details regarding data processing, legal bases and data recipients are specified in the Store’s Privacy Policy, drafted in compliance with the EU General Data Protection Regulation (GDPR).
- Personal data is processed primarily to fulfil sales contracts and process orders. Legal grounds for processing include contract performance, legal accounting obligations and the Seller’s legitimate business interests for dispute prevention and claims management.
- Provision of personal data is voluntary yet contractually required; refusal to provide mandatory data will prevent order processing and contract conclusion.
- Buyer personal data will be stored until the expiry of contractual obligations, legal retention periods, legitimate business interests or valid objection to data processing, whichever applies.
- Buyers hold the right to access, correct, erase, restrict data processing, data portability and object to processing for legitimate business purposes at any time.
- To exercise data protection rights, Buyers shall contact the Seller using the details provided in Section 2.
- Buyers may submit complaints to the Polish Office for Personal Data Protection if they believe data processing violates applicable regulations.
Section 11 General Reservations
- Buyers are prohibited from uploading or transmitting illegal, harmful or inappropriate content via the Store.
- Each individual order constitutes a separate sales contract requiring independent acceptance of these Regulations, valid solely for the completion of the specific order.
- All contracts concluded under these Regulations are governed by the law of Poland.
- Application of Polish law shall not restrict or override mandatory consumer protection rights granted by cross-border or national legislation, where broader protection applies.
- Store contracts are originally drafted and concluded in the Polish language.
- For disputes involving non-privileged business buyers, the competent court shall be the local court corresponding to the Seller’s registered address.
